For the purposes of this document, the following terms will have the definitions mentioned below:

  • eduMedia: A registered company in the Bordeaux (France) RCS offering online services in the form of a bank of educational resources, as well as a number of services dedicated to learning.
  • Ressources: interactive educational games.
  • Site: https://en.alec-edu.com
  • Services: functionalities and services offered by the Site to users, such as student tracking or assignment of homework.
  • You, the user: a person over the age of 18 — an educator, parent, or administrator using the services offered by the site and holding an account.
  • Student: minor or adult invited by the user to access the site.
  • School: A public or private physical location that provides instruction to students.
  • Subscriber: a person or representative of a legal entity who has subscribed to a subscription offer.
  • Visitor: a user of the Site who has not subscribed to a subscription offer but who can access certain resources available on the Site.
  • Order Form: A document detailing the nature and prices of Subscription Offers, ordered by a Visitor from eduMedia and binding the Parties once it is expressly accepted by eduMedia after the Subscriber's signature. All purchase orders are governed by these Terms of Use.
  • Account: individual account created for the User on the Site.
  • Subscription: Contract between the Subscriber and eduMedia for the use of the Site, its Resources and Services for a given period.

ARTICLE 1 : Purpose

These general conditions of use define the terms and conditions for using the Site and its associated services. Please read them carefully before navigating the Site or using the eduMedia Resources, as they constitute the legal framework for using this Site and its associated services

ARTICLE 2 : Applicability

These conditions are applicable to the User upon acceptance during Account creation on the Site, either by the user or by an eduMedia representative after signing an Order form or a subscription

The user accepts the present general conditions by checking a box when creating their account on the Site.

In any case, as of the date of the first use of the site, the terms of use are deemed read and accepted without reservation. 

In the event of a modification to the present conditions of use, subscribers will receive a notification in the form of an email or a pop-up on our site

Any use of the site after the conditions of use have been modified constitutes acceptance of the new conditions of use by the user.

If these new conditions seem unacceptable to the user, they must stop using the site and associated services. Users with an active subscription can request a prorated refund for the unused portion of their subscription.

The date of the last modification of the general conditions of use is indicated at the top of the page.

ARTICLE 3 : Terms of Registration and Access to the Site

3.1 Access to the Site and Services

Access to the Landing page https://en.alec-edu.com is possible as a Visitor and does not require registration.

Access to the Site including the Resources and associated Services is reserved exclusively for Users who can sign in with username-password or Class code.

3.2 User Access

To subscribe to the Site and create an account, the user must be at least 18 years old.

The first access is made by entering the user's email address. Unless the user has generated their own password (e.g., with the « Family Offer »), an automatic confirmation email is sent to prompt the user to accept the Terms of Use and Privacy Policy and set a password. 

There are different types of user accounts. The list below is exhaustive.

Administrator Account:

The administrator is the designated representative of a School.

In the context of the School subscription, the administrator invites Teacher part of of the School. The administrator logs in to their Administrator Account with their username and password to invite teachers by email or delete inactive accounts.

**Important: Teachers at the school cannot play Alec and/or have their students play it unless they have been invited by their administrator.

Teacher Account

The teacher logs in with their username and password on the website. 

In the case of a School subscription, the teacher receives an invitation from their administrator to accept the Terms and Use and Privacy Policy, and create their login credentials. In the case of a Class subscription or a demo offer, he will receive this invitation from an eduMedia representative. Once connected, the teacher can manage their classes and students in their personal dashboard.

**Important: Students cannot play Alec unless they have been invited by their teacher beforehand.

Parent Account:

The parent logs in with their username and password on the website. In the case of a « family » subscription, he will receive his login credentials from an eduMedia representative. Once connected, the parent can create up to three children's access to the resources.

**Important: Children cannot play Alec unless they have been invited by their parent in advance.

3.3 Student Access:

The user must grant access rights to students or children who cannot register or access the Site on their own. 

3.3.1 Access via a Class Code

« School » and « Class » offers only

One teacher can give a student, a group of students, or a class access by assigning them a code generated automatically by the site. This code does not directly or indirectly reveal the identity of the student. The user must give this code to their students and tell them the web address (en.alec-edu.com/code). Students connect individually via the class code then click on their avatar.

3.3.2 Family access with parental control 

« Family » offer only

When a parent wants to give their children access to the site, they connect to the site with their email address and password. The user creates a player profile and grants access to their child. 

The parent decides on a session duration and can set it in advance. 

The user can find statistics on their children's use of resources in their parent space.

 

ARTICLE 4 : Description of Services

eduMedia offers several subscription plans: 

4.1 « School » offer 

The School subscription allows several teachers and their students to access the following resources and services:

  • Games corresponding to the chosen level(s) of education.
  • An administrative dashboard for every teacher to manage their classes.
  • The number of teacher accounts is limited to 20 per school.
  • There is no limit to the number of classes.
  • Home access included. 
  • A high-speed internet connection is requested.

4.2 « Classroom » offer

The Classroom subscription allows one teacher and their students to access the following resources and services:

  • Games corresponding to the chosen level(s) of education.
  • An administrative dashboard for one teacher to manage his/her classes.
  • The total number of students is limited to 30.
  • Home access included. 
  • A high-speed internet connection is requested.

4.3 « Family » offer

There are two types of Family offers: Monthly Subscription and One year Purchase.

The Family subscriptions allows parents and their children to access the following resources and services:

  • All the games.
  • A dashboard for managing the account (My Account).
  • The number of children's accounts is limited to three.
  • A high-speed internet connection is requested.

4.4 « Library » offer 

The Library subscription allows members of the institution to access resources through a dedicated and secure connector.

This offer does not include associated services. Users only have access to 

  • All games.
  • A high-speed internet connection is requested.

There are no individual accounts, and we do not store the data produced by users.

ARTICLE 5 : Prices and Contract durations

1.1 Prices

eduMedia may revise the prices of the Subscription Offers at any time at its sole discretion. However, the price applicable to the chosen Subscription Offer will be fixed at the time of subscription and will not change despite price revisions on the Site.

The price of the subscription offer is the one indicated on a quote edited by eduMedia. 

1.2 Payment and billing terms

The payment methods and prices may differ depending on the subscription plan and country. The subscription takes effect upon receipt of payment or payment confirmation. 

Once the payment is received, the subscriber will be notified by email of the contract's effective date.

1.3. Duration / resiliation 

Your subscription begins on the date we receive your payment or proof of payment and ends on the date indicated on your invoice. Except for the Family monthly Subscription, EduMedia does not use tacit renewal.

As a result, users who registered for the one-year School, Classroom, Library, or Family offers don't have to cancel their contracts, as they will terminate automatically at the end of the billing period.  

Family monthly subscribers can cancel their subscription at any time and continue to have access to the services until the end of the billing period. To cancel your subscription, click on « My Account » and then click on « Cancel Subscription ». Payments for partial use of the services are non-refundable.

ARTICLE 6 : Intellectual Property and Copyrights

The content of this site (illustrations, animations, games, graphics, etc.) and all necessary software are protected by the Code of Intellectual Property and all applicable international standards, and constitute, unless otherwise indicated, the exclusive property of eduMedia, except some pictures of sculpture and paintings part of the two following games Painting and Art-Puzzle (Preschool catalog).

eduMedia does not grant the User any license or rights other than the right to access the Site for educational and pedagogical purposes only. Consequently, the User is prohibited from:

  • to disseminate the Site's content by any means;
  • to reproduce all or part of the Site's elements in any way other than using the capture and sharing tools proposed by eduMedia.
  • to scrape the Site or download any of its content.
  • to perform reverse engineering on the code source of eduMedia resources.
  • To use eduMedia resources for commercial activities or advertising  without negotiating with eduMedia.
  • To exploit and/or share all or part of the Site's content by any means and in any form.

Any use of the Site's content or any of its elements that is contrary to the present conditions will engage the civil and criminal liability of the User towards eduMedia.

Furthermore, in the event of a violation by the User of any of the aforementioned conditions, eduMedia will have the right, without notice, to suspend access to the Site and/or terminate the User's subscription, and will retain any sums paid by the User.

ARTICLE 7 : Personal data and cookies

eduMedia places great importance on respecting your privacy.
We invite you to consult our charter on the processing of personal data in the document Privacy Policy.

EduMedia servers for the English and Spanish versions of Alec are located in Canada. 

ARTICLE 8 : Liability Disclaimer:

eduMedia is responsible for maintaining the online service and ensuring the accessibility of the server that hosts its website, except for occasional interruptions for maintenance. eduMedia cannot be held responsible for failures caused by other factors, including potential network saturation or if the subscriber's equipment, connections, and software are defective, incompatible, or insufficient for this type of operation. Similarly, it is the responsibility of the subscriber to ensure that the filtering or protection devices he has implemented do not prevent access to the Site.

eduMedia strives to ensure the accuracy and timeliness of the information on the Site, and reserves the right to correct its content at any time and without notice. However, eduMedia cannot guarantee the accuracy of the information made available on the Site.

Consequently, eduMedia declines all responsibility:

  • for any interruption of the Site, occurrence of bugs, or other events rendering the Site improper for its intended use;
  • for any inaccuracy or omission regarding the information available on the Site;
  • and, more generally, for any direct or indirect damage, regardless of the cause or nature, resulting from the consultation and use of the Site.

ARTICLE 9 : Force majeure

Neither party may be held responsible for the non-performance or delay in performance of an obligation under this contract due to the other party's failure to comply with the terms of this contract as a result of a force majeure event as is usually recognized by Canada law.
